Becker Glynn Secures Summary Judgment Dismissal in Maryland State Court For Client Accused of Fraudulent Conveyance
A Becker Glynn team, led by litigation partner Jesse Conan and associate Claire Bartholomew, won summary judgment for our client, a U.S. provider and distributor (owned by a European group) of wireless telecommunication devices and services. The plaintiff, claiming that our client’s former employee had used proceeds from an alleged multi-million-dollar illegal kickback scheme to acquire a 10% stake in our client, had asserted a fraudulent conveyance claim against our client, asked the court to impose a constructive trust over the acquired shares or the funds used for the purchase, and sought damages directly against our client.
The Becker Glynn team argued that dismissal was required because there was no evidence of any impropriety in connection with the former employee’s acquisition of the 10% stake. The Court agreed, holding that the 10% stake had not been acquired by fraud, and awarded summary judgment on both the fraudulent conveyance and constructive trust claims.
